TERMS AND CONDITIONS

1. INTRODUCTION AND ACCEPTANCE OF TERMS
Welcome to Jobaa.org ("Jobaa," "we," "us," or "our"), Africa's leading job portal connecting employers and job seekers across all African countries.
By accessing or using the Jobaa.org website and mobile applications (collectively, the "Platform"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms constitute a legally binding agreement between you and Jobaa.org, operated from Acacia Mall, Kampala, Uganda. Our Privacy Policy, Cookie Policy, and other supplementary policies are incorporated into these Terms by reference.
2. DEFINITIONS
"Platform" means the Jobaa.org website, mobile applications, and all related services.
"Job Seeker" means an individual user seeking employment opportunities through the Platform.
"Employer" means any company, organization, recruitment agency, or entity posting job opportunities on the Platform.
"Job Posting" or "Job Ad" means an advertisement for an employment opportunity posted by an Employer on the Platform.
"User Content" means any information, data, text, photographs, resumes, CVs, job descriptions, or other materials uploaded or posted by Users.
"Services" means all features, tools, and functionalities provided through the Platform.
3. ELIGIBILITY AND REGISTRATION
3.1 Age Requirement
You must be at least 18 years of age or the age of majority in your jurisdiction to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.
3.2 Account Registration
To access certain features of the Platform, you must create an account by providing accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
3.3 Employer Verification
If you register as an Employer, you represent and warrant that:
- You have the authority to bind your organization to these Terms
- All information provided about your organization is accurate and truthful
- You are legally authorized to recruit and hire employees in the relevant African countries
4. USE OF THE PLATFORM
4.1 Permitted Use
The Platform is provided for the following purposes:
- Job Seekers: To search for employment opportunities, create profiles, upload resumes/CVs, and apply for jobs
- Employers: To post job vacancies, search for candidates, review applications, and communicate with potential employees
4.2 Prohibited Activities
You agree NOT to:
- Post false, misleading, or fraudulent job listings or resumes
- Impersonate any person or entity
- Use the Platform for any unlawful purpose or in violation of these Terms
- Harvest, scrape, or collect User data without authorization
- Transmit viruses, malware, or any harmful code
- Interfere with or disrupt the Platform's operation
- Post content that is discriminatory, offensive, defamatory, or violates the rights of others
- Use automated systems (bots, scrapers) to access the Platform without permission
- Reproduce, sell, or redistribute Platform content without written consent
- Post pyramid schemes, multi-level marketing, or other fraudulent business opportunities
- Discriminate based on race, ethnicity, gender, religion, age, disability, or any other protected characteristic under African laws
4.3 African Focus
While Jobaa operates across all African countries, Users must comply with the employment laws and regulations applicable in their respective jurisdictions.
5. JOB SEEKER TERMS
5.1 Profile and Resume
Job Seekers may create profiles and upload resumes/CVs to the Platform. You grant Jobaa a non-exclusive, worldwide license to display, store, and share your profile and resume with potential Employers.
5.2 Applications
When you apply for a job through the Platform:
- Your application and associated materials are sent directly to the Employer
- Jobaa is not responsible for Employers' hiring decisions or employment outcomes
- You authorize Jobaa to track application status and provide analytics
5.3 No Fees for Job Seekers
Job Seekers can access basic Platform services free of charge. Premium features, if any, will be clearly identified with associated costs.
5.4 Job Alerts
You may opt-in to receive job alerts and notifications via email, SMS, or push notifications. You can unsubscribe at any time through your account settings.
6. EMPLOYER TERMS
6.1 Job Postings
Employers may post job opportunities on the Platform subject to these requirements:
- All job postings must be for genuine employment opportunities
- Job descriptions must be accurate, complete, and not misleading
- Postings must comply with applicable employment laws
- No discriminatory language or requirements are permitted
- Contact information provided must be valid and monitored
6.2 Pricing and Payment
Job posting fees and premium services are available as detailed on our pricing page. Payment terms include:
- Fees must be paid in advance unless otherwise agreed in writing
- All fees are non-refundable unless specified otherwise
- We reserve the right to modify pricing with advance notice to active Employers
- Accepted payment methods include mobile money, bank transfers, and credit/debit cards
6.3 Resume Database Access
Employers with premium subscriptions may access our resume database subject to these conditions:
- Access is for internal recruitment purposes only
- Contact information may not be shared with third parties without candidate consent
- Automated downloading or scraping is prohibited
- Compliance with data protection laws is mandatory
6.4 Content Review and Removal
Jobaa reserves the right to:
- Review, edit, or remove any Job Posting that violates these Terms
- Reject postings that are not in the best interest of the Platform or its Users
- Suspend or terminate Employer accounts for violations
7. CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY
7.1 Platform Content
All content on the Platform, including but not limited to text, graphics, logos, software, algorithms, and design elements, is the exclusive property of Jobaa and is protected by copyright, trademark, and other intellectual property laws.
7.2 User Content License
By posting User Content on the Platform, you grant Jobaa:
- A worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content
- The right to display your content to facilitate employment matching
- Permission to use your content for marketing and promotional purposes (with your consent)
7.3 User Content Responsibility
You retain ownership of your User Content and are solely responsible for:
- The accuracy and legality of all content you post
- Ensuring you have the rights to post such content
- Any consequences arising from your posted content
8. PRIVACY AND DATA PROTECTION
8.1 Data Collection and Use
Jobaa collects, processes, and stores personal data as described in our Privacy Policy. By using the Platform, you consent to such processing in accordance with applicable data protection laws, including:
- African Union Convention on Cyber Security and Personal Data Protection
- Individual country data protection regulations
- International data protection standards
8.2 Cross-Border Data Transfers
As a pan-African platform, your data may be transferred and processed across different African countries. We implement appropriate safeguards to protect your information.
8.3 Third-Party Sharing
We do not sell your personal information. We may share data with:
- Employers (when you apply for jobs)
- Service providers who assist in Platform operations
- Legal authorities when required by law
9. COMMUNICATIONS
9.1 Platform Communications
By creating an account, you consent to receive:
- Transactional emails (application confirmations, account updates)
- Service announcements and updates
- Marketing communications (with opt-out option)
9.2 SMS and Mobile Notifications
If you provide a mobile number, you may receive SMS notifications for:
- Job alerts matching your profile
- Application status updates
- Security notifications
You can opt-out of non-essential communications at any time.
10. THIRD-PARTY CONTENT AND LINKS
10.1 No Endorsement
Jobaa does not endorse or verify:
- Individual Employers or their job postings
- Job Seekers or their qualifications
- Third-party websites linked from the Platform
10.2 External Links
The Platform may contain links to third-party websites or services. We are not responsible for:
- The content, accuracy, or practices of external sites
- Any transactions or interactions you have with third parties
- Privacy practices of external websites
You access third-party sites at your own risk and subject to their terms and conditions.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
11.1 Platform Availability
Jobaa provides the Platform on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that:
- The Platform will be uninterrupted, secure, or error-free
- Job postings are accurate or current
- Any particular employment outcome will result from using the Platform
11.2 No Employment Relationship
Jobaa is a technology platform that facilitates connections between Employers and Job Seekers. We are NOT:
- An employment agency or recruiter
- A party to any employment relationship
- Responsible for hiring decisions, employment terms, or workplace conditions
- Liable for disputes between Employers and Job Seekers
11.3 Limitation of Liability
To the fullest extent permitted by law, Jobaa and its affiliates, directors, officers, employees, and agents shall NOT be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Any damages arising from your use or inability to use the Platform
- Actions or omissions of Employers, Job Seekers, or third parties
Our total liability to you for all claims shall not exceed the amount you paid to Jobaa in the twelve (12) months preceding the claim.
11.4 Jurisdictional Variations
Some jurisdictions do not allow certain liability limitations. In such cases, our liability is limited to the maximum extent permitted by law.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Jobaa, its affiliates, and their respective directors, officers, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Platform
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any employment relationship or hiring decision involving you
13. TERMINATION
13.1 Termination by You
You may terminate your account at any time by:
- Deleting your account through Platform settings
- Contacting our support team at [email protected]
13.2 Termination by Jobaa
We reserve the right to suspend or terminate your account immediately and without notice if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- Your account has been inactive for an extended period
- We believe your actions may harm Jobaa or other Users
13.3 Effects of Termination
Upon termination:
- Your access to the Platform will cease
- Your User Content may be deleted (though some data may be retained as required by law)
- Outstanding payment obligations remain due
- Provisions that by their nature should survive will continue (e.g., indemnification, disclaimers)
14. DISPUTE RESOLUTION
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Uganda, without regard to its conflict of law provisions.
14.2 Jurisdiction
Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Kampala, Uganda.
14.3 Informal Resolution
Before initiating formal proceedings, you agree to contact us at [email protected] to attempt to resolve the dispute informally.
14.4 Arbitration (Optional)
Where permitted by law, disputes may be resolved through binding arbitration under the rules of the Uganda Arbitration Association or another mutually agreed arbitration body.
15. MODIFICATIONS TO TERMS
15.1 Right to Modify
Jobaa reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform unless otherwise specified.
15.2 Notice of Changes
We will notify Users of material changes through:
- Email notification to registered Users
- Prominent notice on the Platform
- In-app notifications
15.3 Continued Use
Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Platform.
16. GENERAL PROVISIONS
16.1 Entire Agreement
These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Jobaa regarding the Platform.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Waiver
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Jobaa may assign these Terms at any time without notice.
16.5 No Partnership
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Jobaa.
16.6 Force Majeure
Jobaa shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
16.7 Language
These Terms are provided in English. In the event of any translation, the English version shall prevail.

18. SPECIAL PROVISIONS FOR AFRICAN JURISDICTIONS
18.1 Compliance with Local Laws
Users must comply with all applicable employment and labor laws in their respective African countries, including but not limited to:
- Employment equity and non-discrimination laws
- Minimum wage requirements
- Work permit and visa requirements for cross-border employment
- Industry-specific regulations (e.g., mining, healthcare, education)
18.2 Multi-Country Operations
Given Jobaa's operations across all African countries, special considerations apply:
- Job postings must specify the country and location of employment
- Employers must verify eligibility to work in the specified country
- Cross-border recruitment must comply with immigration laws
- Currency for salary information should be clearly stated
18.3 Language Support
While the Platform primarily operates in English, we respect Africa's linguistic diversity. Job postings may be made in local languages, and Users are encouraged to specify language requirements clearly.
18.4 Mobile-First Approach
Recognizing that many African users primarily access the internet via mobile devices, Jobaa is optimized for mobile use. Data charges may apply based on your mobile service provider.
By using Jobaa.org, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
